AliveCor used three patents invalidated by the Patent Trial and Appeal Board of the United States Patent and Trademark Office in a complaint to the International Trade Commission, favoring Apple.

The heart rate monitoring technology used in AliveCor products is the subject of all the patents.

AliveCor filed a complaint with the ITC accusing Apple of violating several of its patents with the Apple Watch in April 2021.

In June, an ITC judge decided in AliveCor's favor. Apple is currently appealing the initial ITC finding that it violated AliveCor patent technology. The ITC might impose an import ban on the Apple Watch if a final decision finds that Apple violated the patents.

AliveCor used three patents against Apple, and Apple requested a review of the claims in those patents. Multiple claims in U.S. Patent Nos. 10,638,941, 10,595,731, and 9,572,499 are "held to be unpatentable," according to the USPTO's Appeals Board.

Apple said in a statement that the ruling supports the invalidity of the patents AliveCor used to sue Apple and obtain an ITC injunction.
